Biometric Information Notice and Explicit Consent

This notice explains how Fathom Video Inc. (“Fathom,” “we,” “us,” or “our”) collects and uses voice biometric data. It supplements our Privacy Policy. Fathom is the controller of this data. You may contact us at privacy@fathom.video. 

Fathom  collects and uses  recordings of your voice and a mathematical representation derived from those recordings, known as a voiceprint.  The voiceprint is biometric data used as set forth below. Fathom retains the source recording as described below. 

Fathom uses an automated biometric-verification system to compare your voiceprint on a one-to-one basis with the voiceprint previously enrolled for your account. We do not use this system to search for your identity among a group of people or to infer your emotions, health, racial or ethnic origin, political opinions, religion, sexual orientation, or other sensitive characteristics.

‍Purpose of Collection

Your voiceprint is collected and used solely for the following purposes:

  • Speaker recognition and transcript diarization: to compare characteristics of your speech against your enrolled voiceprint, distinguish when you are speaking from when other participants are speaking, and label or attribute the corresponding portions of a transcript to you.
  • Transcript accuracy: to improve the accuracy of speaker labels and correct attribution of statements within meeting transcripts.

We do not use voiceprints for advertising,  profiling, product training, or any purpose incompatible with the purposes above. We will obtain a new consent before using your voiceprint for a materially different purpose.  

Our legal bases are your consent under Article 6(1)(a) GDPR and your explicit consent under Article 9(2)(a) GDPR. Providing a voiceprint is voluntary.

Retention and Destruction

Your voiceprint will be retained only until the first of the following occurs:

  • you withdraw your consent or validly request deletion;
  • the date on which the initial purpose for collecting the voiceprint has been satisfied; or
  • one  year after  your account termination or last interaction with Fathom, whichever occurs first.

Following withdrawal or expiration of the applicable period, we will delete the voiceprint, unless limited retention is required by applicable law or necessary for the establishment, exercise, or defense of legal claims. Any such retained data will be isolated and used only for that purpose.  

Recipients and International Transfers

We do not sell, lease, trade, or otherwise profit from your biometric information. Your voiceprint will not be disclosed to third parties except  to service providers such as biometric technology providers, cloud-hosting providers, security vendors, and competent authorities where disclosure is legally required. Service providers may process the data only on our documented instructions and subject to contractual confidentiality, security, deletion, and use restrictions.  

Fathom and some service providers are located in the United States or other countries outside the EEA. Where required, we use the transfer mechanisms set forth in our Privacy Policy. 

Your Rights

Subject to applicable law, you may request access to, rectification or erasure of, restriction of processing of, or portability of your personal data. You may withdraw consent at any time and lodge a complaint with the supervisory authority in your country of residence, place of work, or place of the alleged infringement. 

Withdrawal will not affect the lawfulness of processing performed before withdrawal. You may withdraw your consent and delete your voiceprint by emailing us at privacy@fathom.video.  After withdrawal, Fathom will stop consent-based processing and delete the voiceprint as described above. 

Explicit Consent

By clicking “I Agree, Continue,” you expressly confirm that:

  • You have received  and read this notice  before any voiceprint  is collected ;
  • You have been informed of the specific purposes,  length of time**, recipients, and international transfers** for which your biometric information will be used and retained;
  • You voluntarily and explicitly consent to the collection,  creation, storage, comparison, disclosure, and other use of your  voice recording and voiceprint as described above; and
  • You understand that you may withdraw consent at any time  without affecting processing that occurred before withdrawal.
